4 directions that will change the approach to accounting in 2021

The pandemic that happened in 2020 significantly affected the usual course of life and, of course, the business sector. Decrees of the President and subsequent Decrees of the Government, clarifications and innovations in laws and codes – forced accountants to quickly find, analyze the nuances and introduce new information into their work. Will it be easier in 2021 for accounting specialists? Hardly. But many problems can be avoided if you follow the well-known phrase – forewarned is forearmed!

1. FAREWELL, UTII! NEXT?

One of the most frequently used taxation regimes in micro and small businesses is closing. You need to choose a new SNO before December 31, 2020. At the same time, UTII will cease to operate, even if the taxpayer does not file an application for deregistration. And no notifications will be sent.

What to choose instead of UTII? Many accountants are leaning towards a patent, although it was not very popular with UTII, but now there is not much choice.

Moreover, in 2021, opportunities will expand when using PSN:

– it will be possible to reduce the tax – to deduct insurance premiums for oneself and for employees, sick leave from the accrued amount (at the expense of the employer for the first three days of temporary disability benefits). The main condition is that employees work in the field prescribed in the patent, and contributions are paid during the period for which the patent is issued. Individual entrepreneurs without employees can reduce the amount of tax by 100%, those who provide work – up to 50%. Do not forget to file a tax reduction notice with the tax office;

– From January 1, more categories of citizens will be able to use PSN: all photographers; teachers of preschool and additional education (and not only those who teach in courses and tutors), cooks who cook and deliver food to celebrations; farmers, including those growing plants;

– until 2024, tax holidays for entrepreneurs on the PSN will operate. But there are several conditions for their application – the existence of an appropriate regional law, the registration of an individual entrepreneur after the adoption of this law, and activities related to the preferential industry;

– Preferential patents are being introduced, again with some BUTs: they will be issued for periods from 01.01 to 03.31.2021 only for a few areas – retail, catering, parking lots and car services. At the same time, only those who have already been engaged in these types of activities in the last quarter of 2020 will be able to issue preferential patents.

There will be new restrictions: there will be a list of those activities where the use of a patent will be prohibited from January 1, 21st. And most importantly, after all the changes at the federal level, the relevant laws should be adopted in the regions, but far from all subjects of the Russian Federation have done this. And while it is not completely clear how exactly the cost of a patent will be calculated. So with the change of CHO, there will be no less cases for accountants. It will be necessary to monitor and promptly respond to all clarifications.

2. HELLO, REMOTE!

The forced vacation, which was introduced this spring due to the pandemic, revealed significant gaps in the organization and control of remote work. At the same time, many entrepreneurs have realized that working remotely is more profitable. And some even switched to cooperation with the self-employed, instead of maintaining a full-time employee – less tax deductions and, if there is an office, the cost of renting it.

But along with the benefits, there are also difficulties, the main of which is the preparation of competent contracts and additional agreements. With the beginning of the new year, the moratorium on GIT inspections will cease to operate, and specialists will go to the enterprises in January and February. If the contract is recognized as labor, the business cannot avoid additional costs due to the recalculation of taxes and fines.

Accountants must take this into account so as not to set up the employer and, as a result, will not lose their earnings.

It is also important now to submit reports on remote employees on time – about dismissal, transfers and remote work due to the coronavirus. In Moscow, it is necessary to submit an additional report – about employees transferred to remote work and those who continue to work in offices. It is possible that this will be introduced in the regions.

In addition, it is necessary to constantly monitor changes in legislation not only for remote work, but also in connection with restrictions due to the coronavirus. Regional authorities, depending on the situation with the incidence, can change the restrictions that affect the work of enterprises almost every week.
